A car sped out of control at a North Georgia auto action on Tuesday, resulting in 27 injuries. The accident occurred at the Blue Ridge Auto Auction, in Ellijay, Georgia. Witnesses say the driver began accelerating rapidly, and sped into a crowd of people. Victims in the crowd suffered head trauma, broken bones, scrapes, and bruises. Most victims were treated and released at the scene of the accident. However, one victim is still listed in critical condition and five others are in stable condition at local hospitals. No charges have been filed against the driver of the car, who is an employee of the auction. Police have not yet said why the driver lost control of the vehicle.
If you are involved in an accident caused by an employee performing the duties of his or her employment, you may have a claim against the driver's employer under the legal doctrine of "respondeat superior." Respondeat superior, Latin for "let the master answer," allows for recovery against an employer in the event that an employee causes injury while acting in the scope of employment. For example, if a pizza delivery driver injures someone in an accident while on the job, the injured party would have a claim against the pizza company for damages caused by the employee.
